• The challenge to Order 745 says FERC went too far and redefined "certain retail customers' decisions not to purchase energy at retail … as equivalent to producing electric energy for sale at wholesale...."
• Among the ones who filed the challenge are the American Public Power Association (APPA), the Edison Electric Institute (EEI) and PJM Interconnection.
